The contract of holiday occupancy is between the Owners (the owners of the property), hereinafter called the “Owners” and the person or persons occupying the holiday property hereafter referred to as the “Guest” (The Guests hiring the accommodation either for pleasure or business). Sorry no coaches. And no pets.
1. The contract is between Owner and Guest.(The Guest hiring the accommodation either for pleasure or business) The holiday occupancy of the accommodation is between the Owners on the one hand and the Guest on the other hand, and the Guest must agree to these conditions as part of the holiday occupancy. Any person hiring the accommodation must be over 18 years of age. The Owner reserves the right to refuse any booking without stating any reason. Any booking is only considered confirmed after the Owners check and confirm the booking in writing and the deposit has been received. (The bank usually takes about 4 days to confirm receipt of payment.) 2. Arrival and vacating times.The accommodation period starts after 3 PM (1500 Hrs.) on the day of arrival and finishes at 10 AM on the day of departure. This allows the Owners to ensure the accommodation has been cleaned properly to their high standards of cleanliness. Guests may arrive between 1500 Hrs. (3PM) and 2100 Hrs. (9PM). The Guest agrees to advise the Owners of their time of arrival. Otherwise the Owners may not be present to register the Guests. 3. Payment for the booked period.Bookings can be made at any time up to one year in advance. Please note that for online bookings via Frontdesk/Eviivo full payment of the nights booked is required at the time of booking. For other booking agents and direct bookings the guest agrees to the owners deducting a minimum of the first night from a credit card for B&B and 25% for self catering. This payment confirms the booking and is non refundable under any circumstances. 4. Maximum number of people allowed, and Guest’s responsibility.The maximum amount of people occupying the accommodation is restricted to the number of beds in the accommodation. For the “Holiday Cottage” with four beds the number of Guests is restricted to 4 people (not including babies). For the six-bedded cottage the maximum is restricted to 6 people. If a person occupies a bed (toddler and older) they are considered one of the 4 or 6 people allowed in the accommodation and any additional over the four (or six) are not permitted except with prior approval (for an additional charge extra beds are available). For the B&B this also applies (i.e. a double room can only have two people). The Guest booking the accommodation is responsible for the accommodation and may not sublet or allow other or additional people to stay at the accommodation. The Owner reserves the right to terminate the hire without notice and without any refund for the entire booked period if these conditions are not met. Regarding the children's play equipment and play area in the garden. It is a condition of use that the child is ALWAYS accompanied by an adult. The adult will be responsible for the child and its/their actions etc. If the adult considers the equipment unsuitable at any time they must remove the child and inform the Owners as soon as possible. 5. Availability of the accommodation.In the unlikely event that the accommodation becomes unavailable due to causes beyond the control of the Owners, including but not limited to “Force Majeure” — the booking can be cancelled and the Guest will be offered alternative dates for accommodation if possible. If these are not acceptable to the Guests the full amount of any money paid will be refunded. It is a condition of accepting the original booking that the Guests accepts the return of the monies as complete and final compensation. Under no circumstances will any other compensation be paid and all liability of the property Owner shall cease. It is the responsibility of the Guest to have adequate and suitable holiday insurance. 6. Damage to the accommodation and cleanliness.Bookings are only accepted on the condition that the Guest pays for any and all breakages or damage to any part of the property inside or outside. For damage over £100 the amount will be determined by one quote for repair and the Guest accepts that this will be accepted in the unfortunate event of any damage or breakage occurring. (If further quotes are required the Guest agrees to pay £25 per hour to the Owner for obtaining these additional quotes). The Guest agrees to notify the owner of the property immediately and before leaving the property regarding any damage. The Guest agrees to pay for the full amount of the damage. (Guests are encouraged to take out holiday insurance.) Further the Guest agrees all bookings are accepted on the condition that the property is left clean and tidy. The Guest making the booking will pay for any and all breakage, additional cleaning (if required), and/or damage. The Guest further agrees the Owner can charge the Guest's Credit Card for amounts of all breakages, additional cleaning or damage without further reference to the Guest. All equipment, utensils etc. must be left clean and tidy at the end of an occupancy. If a damage/cleaning deposit has been paid when booking this will be refunded within 7 days of the Guest leaving — less any damage or cleaning amounts. The damage/cleaning amounts the Guest agrees are at the sole discretion of the owners. 7. Access to the accommodation.The Guest accepts that the Owners of the property and/or their representative will be allowed reasonable access to the property during the holiday occupancy period, if so required by the Owners. The Guest also accepts that any trades person may enter the accommodation to carry out repairs at any time. The Owner will endeavour to contact the Guest beforehand. 8. Bed Linen & Cots.The Cottages and B&B are supplied with bed linen; sheets, pillowcases, blankets and/or duvets. In the bathroom, bath towels, hand towels, bath mat, and in the kitchen tea towels are also supplied all at no additional cost. No sleeping bags are allowed. Cots are supplied as a cot with a basic mattress, the Guest should bring whatever cot linen they require. No towels are to be removed from the rooms. 9. Guest's effects and Cars.All Guests effects belonging to the Guests are the responsibility of the Guests and are only accepted on the Northwood Cottages premises with the condition that the Owners are not liable in any way or form, either for loss, damage or any other peril of the Guest's possessions. The Owners are also not responsible for any vehicle or its contents. It is a condition of this holiday occupancy that the Guest and their family and guests have insurance to cover all incidents of any kind to their possessions. 10. Charges in the event of a cancellation for Cottages or B&B.If for any reason the Guest wishes to cancel the booking the notice must be given to the Owners in writing or by email as soon as possible. The effective cancellation date is taken from the time the letter or email arrives. No refunds can be processed without the written cancellation. The owners will endeavour to re-let the cottage(s) or B&B. However even if the cottage or B&B can be re-let the deposit/payment received will be forfeited as a payment for administration expenses. If the cottage or B&B cannot be re-let the following cancellation fees will apply.
To avoid cancellation losses Guests are advised to take out Holiday Cancellation Insurance. 11. In the unlikely event of a complaint.In the unlikely event that the Guest has a complaint of any nature the Owners must be contacted immediately in the first instance. The Owners understand that even in the best-run facility and with every good intention it is possible for a problem to arise. The Owners welcome any constructive criticism so a problem can be solved not only in the particular instance but also for the future improvement of the accommodation. The Owners will handle the problem as quickly and efficiently as possible. No complaint will be recognised unless it is reported while the Guest is in the accommodation and reported at the time of the incident; the Owners must be given the opportunity to rectify the problem during the holiday while the Guest(s) are present. 12. The Manston Guest House web site and any other publication.While the Owners act in good faith and try to get all the information correct, however they cannot be held responsible for:
13. Liability of Owner.The Owner's liability will not in any event, exceed the amount actually paid by the Guest for rental accommodation hired from the Owner. No verbal agreement even if made in good faith, will replace the conditions set out in these booking terms and conditions of holiday occupancy. This is a condition of the booking. Further the “Guest” agrees to supervise any/all children on the play equipment at all times and take full responsibility, and have insurance for any incidents. The Owners do not accept any responsibility whatsoever for any and all mishaps/injury etc. however caused. 14. Price and other changes.The Owner reserve the right to amend prices quoted in brochures, on the web site or in any other location due to errors and/or omissions, changes to tariff, Credit card or other additional charges, or changes to the VAT rate. Also the Owner reserves the right to change, without notice, any specifications, amenities or any other item related to the Manston Guest House, self-catering or the B&B. 15. Guest’s insurance.The booking made by the Guest for accommodation is a legally binding contract. It is strongly suggested and recommended, for the Guest's protection, that the Guest has insurance against cancellation and any other event the Guest may require to make a holiday trouble free. 16. Smoking and Pets.In the B&B there is NO smoking and NO pets allowed. In the self-catering there is NO smoking and NO pets allowed. There are several kennels and catteries nearby where guests can leave their pets but we are sorry we cannot accept them at Manston Guest House. 17. Notice: Loss of or damage to guests’ property.Under the Hotel Proprietors’ Act 1956, a hotel proprietor may in certain circumstances be liable to make good any loss of or damage to a guest’s property even though it was not due to any fault of the proprietor or staff of the hotel.
